Welcome to pikCarz, operated by Cube Absolute Services (Pty) Ltd ("Cubeas", "we", "us"). By accessing or using the pikCarz platform at pikcarz.co.za, you agree to be bound by these Terms of Service. Please read them carefully.

1. Use of the Platform

pikCarz is an online vehicle marketplace that connects buyers and sellers of motor vehicles in South Africa. You must be at least 18 years of age to register and use the platform. By using pikCarz, you agree to:

• Provide accurate and truthful information in your account and listings.
• Use the platform only for lawful purposes.
• Not engage in fraudulent, deceptive, or misleading activity.
• Not scrape, copy, or redistribute content from the platform without permission.

2. Listings & Content

Sellers are solely responsible for the accuracy and legality of their listings. When you post a listing, you confirm that:

• The vehicle exists and is available for sale at the stated price.
• You are the legal owner or authorised to sell the vehicle.
• All information provided (mileage, condition, history) is accurate.
• The listing does not violate any applicable laws or third-party rights.

pikCarz reserves the right to remove any listing that violates these terms without notice.

3. Subscriptions & Payments

Certain features of pikCarz require a paid subscription. Subscription plans and pricing are published on the platform. Payments are processed via PayFast, a South African payment gateway. All fees are non-refundable unless otherwise stated. Subscriptions renew automatically unless cancelled before the renewal date.

4. Prohibited Activities

You may not use pikCarz to:

• List stolen vehicles or vehicles with fraudulent documentation.
• Engage in spam, phishing, or unsolicited communications.
• Impersonate any person or entity.
• Circumvent, disable, or interfere with platform security features.
• Post content that is offensive, defamatory, or illegal.

5. Disclaimers

pikCarz acts solely as a marketplace and is not a party to any transaction between buyers and sellers. We do not verify the accuracy of listings, inspect vehicles, or guarantee the completion of any sale. Users transact at their own risk. We strongly encourage buyers to conduct independent inspections and verify vehicle history before purchase.

6. Limitation of Liability

To the fullest extent permitted by law, Cubeas and pikCarz shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to losses arising from reliance on listing information or transactions conducted through the platform.

7. Intellectual Property

All content on pikCarz — including the logo, design, text, and software — is the property of Cube Absolute Services (Pty) Ltd and is protected by applicable intellectual property laws. You may not reproduce or distribute any content without prior written permission.

8. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms of Service or engage in activity that is harmful to the platform or its users.

9. Governing Law

These Terms of Service are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of pikCarz after changes are posted constitutes acceptance of the revised terms.
